ARBITRAL RESOLUTIONS OF COMMERCIAL LITIGATIONS IN THE LIGHT OF UNCITRAL MODEL LAW

Abstract

The author points out the importance of a quality arbitral process, particularly in commercial disputes. The author analyzes the solution of UNCITRAL Model Law and order regarding the appointment of arbitrators, their characteristics, powers and limitations of arbitration, and the arbitration proceedings itself. He also indicates the direction in which it would be necessary the national legislation to be harmonized, taking into account the current world standards set out in the field of arbitration law. The author’s attitude towards the amended Model Act is quite affirmative, so he concludes that it is necessary to continue with the harmonization of national legislation, especially regarding the lessons drawn from the states with a longer and richer empirical tradition of arbitration.
