Abstract

We reasonably believe that our article confirms the proposed the me “Serbian Law – now and then” that the idea of legal development, as the plat form of modern Serbia, has been lasting for almost 200 years. Following this idea, we have tried to revive numerous regulations regulating different areas, how they are used in judgments attached to this article, their great importance for understanding their substance, language and style, and adaptability to the needs and challenges of present time, underlying solutions which are sometimes even better than the current ones. By developing this idea, we believe, we have proven that the Serbian legal thin king had its uprisings, that the Serbian law had its jewels, and that it is necessary to get rid of the feeling that the only way out for our law is to copy and accept what the others have already prescribed.

Presented judgments will certainly be of a great importance for young lawyers to get to know them better, to analyze them closer, to compare them with the current regulations from the area of civil law, and will, de lege ferenda, contribute to further development of Serbian legal thin king.
