TRAVEL ORGANISATION CONTRACT IN SERBIAN LAW

Abstract

Travel organisation contract is a nominated contract, regulated by Serbian law, specifically by the Law on Obligational Relations and the Law on Tourism. On the international scale, the travel organisation contract is regulated by the International convention on travel contracting. In addition to laws and business practices, general business conditions are also important as a legal source for travel contracting in Serbia. This is particularly true of the general terms and conditions set by YUTA (national association of tourist agencies) for its members.

Travel organisation contract is an informal contract in Serbian law. With the new legal obligations for travel organisers, which refer to the obligation of establishing general terms of travel and elaboration of an itinerary, this contract is nearing a formal agreement. The fact that the Law on Tourism prescribes the content of general terms and itinerary of the travel that the traveller must be presented with, shows the intention to protect the weaker side in the contract – the traveller.
