RESPONSIBILITY FOR DAMAGE CAUSED BY LOSSES, IMPAIRMENT OR DELAY OF GOODS IN ROAD TRANSPORT

In the work are displayed national and international regulations, different opinions on legal theory, as well as different attitudes responsibility of a transporter for losses, impairment and delay of goods in road transport.
In the work are analyzed certain regulations, like the law of obligations, the law on contracts in road transport, as well as Covention on the Contract on International Carriage of Goods by Road. Special attention is given to the matters regarding the limit of responsibility and evidential burden on degree of responsibility, liability for impairment of goods due to false shipment or partial offloading, liability for damage for hazardous goods and shortage of packing, liabilities for applying the practice of a good transporter, presumptions on losses of goods in road transport, liability on tardiness in transport, as well as competence of a court ratione loci in a litigation for reimbursement of damages.
