IZVAN DETERMINIZMA – PREISPITIVANJE PRAVNE ODGOVORNOSTI U DOBU PROBABILISTIČKIH VI SISTEMA

Сажетак

Ovaj rad razmatra suštinsku razliku između klasičnog determinističkog programiranja i savremenih sistema veštačke inteligencije, sa posebnim naglaskom na pravne posledice koje proizlaze iz nedeterminističkog ponašanja VI sistema. Analizom osnovnih postulate programiranja, Softmax funkcije kao ključnog mehanizma generisanja izlaza, kao i stohastičkih faktora prisutnih u procesima treniranja i generativne produkcije, pokazuje se da veštačka inteligencija odstupa od uobičajenih očekivanja predvidivosti, što ima dalekosežne implikacije na obligaciono pravo, zaštitu potrošača i režime vanugovorne (deliktne) odgovornosti. Pored teorijskog pregleda, rad pruža i pravnu analizu Akta Evropske unije o veštačkoj inteligenciji (EU AI Act) u kontekstu nedeterminisanosti, ukazujući na regulatorne napore da se ova osobina VI modela normativno obuhvati kroz sistem klasifikacije rizika, kao i kroz tehničke i organizacione zahteve. Rukopis ima za cilj da doprinese interdisciplinarnom razumevanju izazova povezanih sa veštačkom inteligencijom, pozicionirajući pravnu nauku kao ključnog aktera u izgradnji novog modela odgovornosti u digitalnom dobu.
