CONTRACT ON PASSENGERS TRANSPORTATION

Abstract

General and mutual source of the law for all kinds of contract on passengers’ transportation is Obligatory Law. In our law, general regulations on passengers’ transportation are in Obligatory Law, and the contracts on railroad, road, air, navigation and river passenger transportation, are regulated by the special laws.

By the contract on passenger transportation a transporter is obliged to transport the passenger from one to another contracted place, and the passenger is obliged to pay to the transporter corresponding transportation fee. Contracting parties in this contract are passenger, as user of the transportation, and transporter as performer of the transportation. This contract can sign instead of passenger the one that ordered transportation with the transporter.

Contract on passengers transportation is two parties and charged contract, and by the rule informal contract, because it can be concluded in every form, and mostly by buying transportation ticket that confirms the conclusion of the contract on transportation and demonstrates its existence and content.

Only in special cases contract on passengers’ transportation is formal contract, because it has to be presented in written form. This is the case with the contract on passengers’ transportation that is negotiated between the orderer of the transportation and transporter (charter on travel) and contract on passengers transportation that is negotiated on tryst with the whole air vehicle or ship, that is with one part of the airplane or ship (charter on time). They are adhesive contracts that are contracts on admission.
